These Terms of Service ("Terms") constitute a legally binding agreement between you and VaultSeeds s.r.o. ("we," "us," or "our") governing your access to and use of our website, services, and products.

By accessing or using our website, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our website or services.

These Terms include our Privacy Policy and Refund & Return Policy, which are incorporated by reference.

2. Age Restrictions

Our website and services are only available to individuals who are at least 18 years old. By accessing or using our website, you represent and warrant that you are at least 18 years of age. If we learn that we have collected information from an individual under 18 years of age, we will delete that information promptly.

3. Products and Services

Product Description: VaultSeeds s.r.o. sells premium collectible botanical seeds from 34 Street Seed Co. (Canada) exclusively as collectible items, adult souvenirs, and for genetic preservation research purposes. Our product range includes:

Collectible seed varieties (hybrid, indica, and sativa genetics)
Available in 1-seed, 3-pack, 5-pack, and 10-pack packages
Seeds are specialty collectibles with documented genetic lineages
Products are packaged in sealed, tamper-evident containers for preservation

Intended Use: All collectible botanical seeds sold by VaultSeeds s.r.o. are sold as collectible souvenirs and for preservation of genetics for research purposes only. Our products are NOT for human consumption, cultivation, germination, or any use that is illegal in your jurisdiction.

Product Information: We strive to provide accurate product information including genetic lineage, seed characteristics, and collector information. However, we do not warrant that product descriptions, photographs, pricing, or other content of our website is absolutely accurate, complete, reliable, current, or error-free. Seeds are biological materials and individual seed characteristics may vary.

Availability and Pricing: All products are subject to availability, and we reserve the right to discontinue any product at any time. Prices for our products are subject to change without notice. All prices are listed in Euros (€) and include VAT where applicable.

Quality Assurance: We source all products directly from 34 Street Seed Co. and maintain high standards for all our products. Seeds are stored in climate-controlled conditions and shipped in preservation packaging. However, due to the nature of our products as collectibles (not intended for germination), we cannot guarantee seed viability.

4. Ordering Process

How to Place an Order:

Browse our product catalog and select items you wish to purchase
Add items to your shopping cart
Review your cart and proceed to checkout
Create an account or log in (required for order tracking)
Provide accurate shipping and billing information
Select payment method and complete payment
You will receive an order confirmation email with order number

Order Acceptance: Your order is an offer to buy our products. All orders are subject to acceptance by VaultSeeds s.r.o.. We reserve the right to accept or refuse any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspicion of fraudulent activity. If we refuse your order after payment, we will issue a full refund.

Order Confirmation: After placing an order, you will receive an automated order confirmation email. This email confirms we have received your order but does not constitute acceptance. We will send a separate shipping confirmation email when your order is dispatched.

5. Shipping and Delivery

Shipping Restrictions: We ship only to countries and territories where it is legal to ship collectible botanical seeds as collectibles. We do not ship to the following countries: Hungary, Slovakia, Cyprus, Finland, Portugal, France, and Italy.

Shipping Regions and Costs:

European Union countries (excluding restricted countries): €4.99
United Kingdom: €6.99
Rest of Europe (Norway, Switzerland, etc.): €9.99

Shipping Times:

Order processing: 1-2 business days
EU delivery: 3-5 business days (after dispatch)
UK delivery: 5-7 business days (after dispatch)
Rest of Europe: 7-14 business days (after dispatch)

Estimated delivery times are provided as guidelines only. We are not responsible for delays due to customs clearance procedures, postal strikes, weather conditions, or other factors outside our control.

Discreet Packaging: All orders are shipped in plain, discreet packaging with no external indication of contents. The sender name on the package will not reference botanical or seeds.

Tracking: Tracking information will be provided via email after your order is shipped. You are responsible for monitoring your package's progress using the tracking number provided.

Delivery Responsibility: Once a package is handed to the shipping carrier and tracking shows "in transit," delivery responsibility transfers to the carrier and customer. You must provide a safe, secure delivery address.

Undelivered Packages: If your package is returned to us as undeliverable due to an incorrect address you provided, is refused by you, or cannot be delivered after multiple delivery attempts, no refund will be issued. If the package is returned due to our error, we will reship at no additional cost. See our Refund & Return Policy for details.

Customs and Import Duties: For shipments outside the EU, you are responsible for any customs fees, import duties, or taxes imposed by your country. We have no control over these charges. Packages may be inspected by customs authorities.

6. Payment Methods and Pricing

Payment Security: All payment information is securely processed through Shopify's encrypted payment gateway. We do not store complete credit card information on our servers. All transactions are encrypted using SSL/TLS technology.

Currency: All prices on our website are listed in Euros (€) unless otherwise stated. Your bank or payment provider may apply currency conversion fees if your payment method uses a different currency.

Plus applicable shipping costs based on your location

Taxes and Duties: Prices displayed on our website include VAT where applicable. For shipments outside the EU, prices do not include customs fees, import duties, or local taxes that may be imposed by your country's authorities. You are solely responsible for paying any such charges.

Payment Timing: Payment is due in full at the time of order. Orders will not be processed until payment is confirmed.

7. EU Consumer Rights - Right of Withdrawal

Under EU Consumer Rights Directive 2011/83/EU, consumers generally have the right to withdraw from distance contracts within 14 days. However, this right does NOT apply to our products because:

Article 16(c): The right of withdrawal does not apply to "the supply of goods which are liable to deteriorate or expire rapidly."

Collectible botanical seeds are biological materials that deteriorate if not stored properly and are sealed in preservation packaging. Once shipped, we cannot guarantee their condition if returned.

8. Returns and Refunds

General Policy: Due to the nature of collectible botanical seeds as collectible biological materials, we DO NOT accept returns for change of mind or incorrect ordering.

Exceptions: Refunds or replacements may be issued for:

Orders never shipped by us
Products damaged during shipping (photographic evidence required within 14 days)
Incorrect items shipped (must be reported within 14 days)
Lost packages (if carrier confirms loss)

9. User Conduct

WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT OUR WEBSITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE CONTENT ON OUR WEBSITE OR THE CONTENT OF ANY SITES LINKED TO OUR WEBSITE.

Disclaimer: VAULTSEEDS sells collectible botanical seeds as souvenirs or collector items only. Germination or cultivation of these seeds may be illegal in your country. We do not encourage anyone to break the law in their country.

No Liability: We accept no responsibility for any legal issues that may arise from the purchase, possession, or use of our products in jurisdictions where they are illegal.

These Terms shall be governed by and construed in accordance with the laws of Czech Republic, without regard to its conflict of law provisions.
